An energy storage license is required for business activity when the installed capacity of installations at one measurement site exceeds 5 MW, unless an exception provided by law applies. Start by checking the participant's status, electrical diagram and equipment scope. A contractual export limit alone does not determine whether a license is required.
The business needs two distinct outcomes: a justification for its operating model and a list of documents confirming its conditions. Storage for own consumption, an active consumer's installation and an independent market participant may operate under different legal grounds even with similar equipment.
Which capacity is compared with the threshold?
Licensing uses the installed capacity of the energy storage installation. This is not the battery's energy capacity and cannot be replaced by the capacity ordered for connection. Use the appropriate technical documentation for the actual installation. A commercial offer may show separate battery, converter and grid connection figures, so first establish what each means.
Distinguish power from energy capacity: megawatts measure power, while megawatt-hours measure stored energy. High energy capacity does not automatically mean the licensing threshold is exceeded. Likewise, a software export limit alone is not sufficient grounds to reduce documented installed power.
The threshold is precise: more than 5 MW. Exactly 5 MW does not exceed it, but that alone does not confirm compliance with every condition of the chosen status. Regardless of licensing, import from and export to the grid must remain within the permitted limits for each direction.
The license covers a business entity's activity, not the battery model as a product. A manufacturer's certificate, equipment warranty or another company's license does not authorize the applicant's own licensed activity. Identify in advance who will use the installation and enter into the relevant contracts.
Why the entire measurement site matters
A measurement site is a concept of the electrical scheme and metering, not merely an address or land plot. It includes connected electrical installations with defined measurement points. Do not set its boundaries solely by a fence or number of containers. Check the connection diagram, grid boundaries and commercial metering data.
When installations of other entities are connected to one entity's networks, the total installed capacity of the relevant installations at one measurement site is considered for the licensing obligation regardless of ownership. Dividing equipment among companies does not itself justify counting each battery separately.
Hypothetical example. Two companies place 3 MW storage installations at one measurement site and plan market operations without a special exemption. Their combined installed capacity is 6 MW. Limiting export to 4 MW does not change the installed 6 MW for the licensing assessment. Determine the organizational model and applicant before signing contracts; the aggregation rule alone does not identify the responsible licensee.
When operation without a separate license may be possible
Every condition of an exception must be met. Calling a project "for own needs" or having a solar plant does not replace checks of actual power flows, status and contracts. The scenarios below help identify questions; they do not automatically determine the outcome for a specific facility.
| Scenario | Key condition | What to confirm |
|---|---|---|
| Consumer using storage for own needs | Previously stored energy is not exported to the power system or another entity's networks at any time. | The electrical scheme, control mode and absence of such export, not just a zero monthly balance. |
| Active consumer | Installed power capacity of the storage installation does not exceed permitted consumption capacity unless otherwise provided by law; for the relevant exception, installed storage power at the site does not exceed 5 MW. | Proper status and contracts, total owned and connected installations, and separate metering. |
| Licensed producer | Storage operates at the licensed production location, within permitted export and with separate metering of its flows. | Charging sources and additional restrictions of the producer's particular support mechanism. |
In the general producer scenario, charging may come from own generation and/or the grid, but supported models have specific conditions. In particular, conditions for a feed-in tariff producer in the guaranteed buyer's balancing group must not be applied to every plant. Permitted grid import must also be checked separately.
If the model involves market participation, examine how an active consumer with energy storage operates. Connecting a third party's equipment requires additional review of capacities, contractual arrangements and calculations. An absence of licensing does not remove connection or metering requirements.
A solar plant owner does not become a licensed producer merely by owning panels. To apply the relevant exception, check the current status and licensed activity location. If a business changes from own consumption to selling stored energy, revisit the conclusion before changing operation.
The reverse scenario also exists: a licensed storage operator may use generation at its activity location without a separate generation license under specified conditions. In particular, check total import and export against permitted values and separate metering of storage flows. This is not a universal exemption for any nearby power plant.
Documents to prepare for an application
Submit the application on the current form with the prescribed package. A technical team can organize the material into three groups: rights to use the equipment; identification, parameters and location of the installations; and proof of metering arrangements and equipment readiness.
- Rights and applicant. Ownership or use documents for the means of activity, signatory authority and information on ultimate beneficial owners.
- Equipment. Technical passports or other prescribed technical documents showing installed capacity, information about activity locations and equipment, types and quantities of installations, energy capacity and required identifiers.
- Metering and readiness. A single-line diagram with commercial metering equipment agreed with the relevant system operator and an appropriate readiness document.
The applicant's name, location, equipment models and parameters must agree across files. If a passport describes only one module, check which documents establish the capacity of the full declared configuration. Supplier information, the design diagram and the installed equipment must not contradict each other.
Compare the equipment list, rights documents, diagram and readiness report. For every declared installation, identify its location, the document establishing the right to use it and the declared parameters. Resolve serial number or configuration discrepancies before filing.
The metering scheme shows separate flows into and out of storage. A business's general meter may not be enough to demonstrate the required measurement structure. Arrange commercial metering for storage before finalizing the package to avoid reworking the scheme after submission.
Confirming readiness and submitting an application
How readiness is confirmed depends on the facility. For a stationary structure or installation classified as real property, the appropriate document accepting the completed construction into operation is required. Equipment that can be moved without damage, loss of value or change of purpose is covered by a comprehensive test report and an order bringing it into operation.
A containerized design alone does not establish that an installation falls into the latter case. Check construction, placement and project documentation. See acceptance of energy storage into operation for the construction procedure. Licensing does not replace that procedure or compliance with grid connection conditions.
- Compare the grounds.Record status, measurement site boundaries, installed capacity and whether an exception applies.
- Check the package.Reconcile current forms, authority, equipment rights, the diagram and readiness evidence.
- Submit and monitor.Keep proof of filing, address comments and check the decision.
Documents may be submitted by an available paper or electronic method. Sending an application does not itself authorize licensed activity. The launch plan should allow for completeness checks, possible correction of defects and compliance after the decision. The review period is not a guaranteed commercial start date.
Responsibilities after obtaining a license
The licensee must use the declared equipment at the specified activity locations, meet organizational and technical requirements and keep submitted information accurate. A change of equipment or location requires checking notification or amendment procedures. Assess planned capacity expansion before buying additional modules.
Ongoing operation includes proper metering, mandatory market contracts, reporting and applicable financial obligations. Wholesale market operations also require checking registration and information obligations. A license does not guarantee admission to every market service, profitability or the ability to sell any quantity of energy.
Assign responsibility for the regulatory reporting calendar, contributions and supporting records. Technical staff should notify the responsible employee of installation changes, while finance should identify transactions belonging to the licensed activity. Agree this process before commercial launch.
Information to provide for review before launch
Prepare a concise project record for technical and legal specialists. It helps identify missing data before applying or deciding to rely on an exception.
- Company status, planned operations and charging sources.
- All installations at the measurement site, owners, installed power and technical evidence.
- Network boundaries, permitted import and export, and the agreed metering diagram.
- Equipment rights, readiness documents and the person responsible for changes and reporting.
For an initial technical discussion, discuss your project and provide its diagram and parameters. The licensing conclusion must be made for the specific configuration and current operating conditions.
